  • RDC tabled late information , Linda’s Counsel need time to review so delayed till July.

    RDC were late attending last week and late tabling info this week -I would’nt trust them with my shopping list…….pathetic.

  • No Jim, in fact case adjourned until late July thanks to RDC producing two further bundles of evidence at 2pm this afternoon that the RAG legal team had not seen. Seems as though they expected the judge to just accept it but he was having none of it, so adjournment for RAG team to assess the evidence and have a response ready.

    Sounds highly unprofessional of RDC, reeks of dirty tricks. They really should be ashamed of themselves. To me they are showing themselves up for what they really are.

    Question for any lawyers out there/admin. While this case is going on can they actually go ahead with deciding any planning permissions or would that verge on contempt of court?

  • I’m not a lawyer, but people or companies can always make planning applications. If councils don’t make a decision within a certain time period, applicants can appeal on the basis of non-determination.

  • Christine @ 5 seems our posts crossed in time – and this situation only serves to illustrate the RDC incompetance in terms of interfacing with others ie:- as in lack of effective consultation, I hope the Judge is drawing his own conclusions……….

    I will expect to have definitive legal advice for Members of the Planning Authority on Christine’s question in 5 above in the event that the High Court has not made a decision on the case and there is a planning application to be determined at Development Committee on one of the sites in the Allocations. For the avoidance of any doubt I must say BEFORE I vote one way or another or for deferment.

  • While the case is still going on, and things are still sub judice it is probably best not to publish any further comments on the effectiveness of either sides legal team. Any comments on that will be held back until the case is concluded…..

  • What would be good if any councillors here were to ask RDC what the costs are for defending the action, and who has authorised that expenditure

    Also individuals should ask under Freedom of Information Request for an itemised statement of the costs incurred to date in this action
