From the Daily Mail today:

A council that pretended it didn’t know about a large pothole that damaged a man’s car has been ordered to pay the repair bill after the motorist turned detective and proved the council was lying.

Motorist Frank Cattrall, 62, says his Renault’s suspension was ruined after he drove over an 18-inch wide pothole in his home town of Colchester.

When Essex County Council refused to accept responsibility, Mr Cattrall used a Freedom of Information (FOI) request to find proof that the council did know about it, and then took the council to court.

  • They still haven’t repaired a raised kerb-stone I first reported 8 months ago (and many times since). As its on the pavement, there is a high risk of accidents to pedestrians once the lights go out.
    Its time ECC got this sorted!

  • Quite a few of the filled potholes are cracking up again as well. I noticed in Rawreth Lane yesterday that one of the very long ones that was patched is starting to go again, and also some on the dual carriageway from the A127 to the Carpenters.

  • I ‘m being serious here –
    Given the potholes and missing drain covers ( see pic’s on here down the RH side ),
    If a pedestrian/ cyclist / motorbiker falls foul of one in the dark , can they sue the Council for injury/ damages ?, under ” lack of adequate maintenance “.
    Because if they can I can see this becoming a career for some – just like the false
    car crash claims industry which is now established, point being it will be our money
    used for the payouts – so no cost savings there then.
    Oh sorry of course , all the Developers will be improving London Rd / Rawreth Lane
    before all the Construction Traffic tears up the current patches you mention.
